What fabric can I use when starting my own clothing line?

I am trying to start my own clothing line and I want to start with smocked shirts and dresses. My question is can I use any type of fabric. What are the legalities with using fabric? Can I get into trouble for using a certain print? Anything helps. That is all that's holding me back.
